Traditionally, safety rules, i. e. the legal rules of safe ship operation including those to manage environmental risks, are relatively well developed by international maritime law. But maritime security is still far from a state of perfection, while piracy, terror, organised criminality and illegal trafficking of persons, drugs and weapons of mass destruction continue to threaten the maritime community in many places around the globe.
In the first place there are the inherent rights of self-defence and the duty to render assistance to all those in distress , both mandatory for all ships and captains but very limited in scope. A UN Resolution on the proliferation of weapons of mass destruction and the US initiated Proliferation Security Initiative (PSI) offer new options for counter-measures in certain cases. The fight against piracy is traditionally governed by the UN Law of the Sea Convention (UNCLOS) while in June 2008 the UN Security Council opened up new law to prosecute piracy inside the territorial sea of failed states. The SUA Convention of 2005, not yet in force, will criminalise many acts of violence at sea and introduce new boarding rights in the fight against terror. At the same time, bilateral treaties on inspection and boarding can fill some of the legal gaps. Also, NATO has elaborated a workable concept of "Naval Co-operation and Guidance for Shipping" for the military protection of merchant shipping on a voluntary basis and free of charge.
Finally, there may be a future role for the European Union and its Member States to combat maritime violence and crime. The challenge for Germany is urgent under two aspects. In the first place the German Navy needs a clear mandate (and a legal basis) for the prevention and repression of piracy and maritime violence while operating in overseas waters. In the second place a centralised German coast guard is needed to protect the German coasts and to co-operate with maritime services of neighbouring States in the EU. So far professional emergency plans for the coasts of Germany are in place only to deal with major accidents and environmental disasters. A uniform coast guard with preventive and executive powers is still under discussion, while the German constitution prevents the Navy from intervention.
